This presentation will cover how to enter into a fee agreement with your client, recent changes to the process resulting from passage of the Veterans Appeals Improvement and Modernization Act, and important court cases that govern this area.  When can an attorney or agent enter into a fee agreement and what fees are permissible under the statute?  What is the difference between a withholding and non-withholding fee agreement?  In addition to these topics, Robert and Lindy will discuss when and where fee agreements must be filed, as well as how and when VA reviews agreements.  Samples will be provided. 

 

Robert Chisholm is a partner at Chisholm Chisholm & Kilpatrick in Providence, Rhode Island.  The firm represents veterans and their dependents before the Federal Circuit, the Court of Appeals for Veterans Claims (CAVC), and VA.  Robert is a past president of both the CAVC Bar Association and NOVA.  In 2016, the CAVC awarded the Hart T. Mankin Distinguished Service Award to Robert in recognition of his 25 years of outstanding service to the court.

Lindy Nash joined Chisholm Chisholm & Kilpatrick in 2016 as an associate attorney. She has worked on both the Court and Agency teams at the firm, but currently her practice focuses on representing disabled veterans and their families before VA’s Regional Offices and the Board of Veterans’ Appeals. She is a member of the Rhode Island and Massachusetts State Bars and is admitted to practice before the CAVC.
